How to Apply for a License
The Licensing Department conducts background investigations of all persons and entities that are in any way connected with the Gaming Operation. The Federal Code of Regulation, Chapter 25 gives Gaming Commissions the jurisdiction to conduct background investigations while Federal Code of Regulations §556 and §558, Tribal-State Compacts, and National Indian Gaming Commission Regulations provide the guidelines and requirements for conducting those background investigations.
You must have an offer of employment in a licensed position extended by Red Earth Casino Human Resources Department before applying for a Tribal Gaming license/Non-gaming license.
Similarly, all vendor companies must be referred by Red Earth Casino for Vendor services before applying for a Vendor license or due diligence review.

Key Employee/Gaming Employee or Primary Management Official
Individuals who meet the criteria Key Employee/Gaming Employee or Primary Management Official will complete a gaming application including:
Minimum ten years of residential history; Minimum ten years of employment history; Five personal/character references; Disclosure of all felony charges, arrests or convictions;
Disclosure of all misdemeanor arrests or convictions received within the past ten years;
Disclosure of all arrests or criminal charges received within the past ten years, whether or not there is or was a conviction, if not otherwise disclosed;
Key Employee/Gaming Employee or Primary Management Official applicants defined within CFR 502.14 (a) – (c) or CFR 502.19 (a) – (c) shall be fingerprinted through the Federal Bureau of Investigation to determine the applicant’s criminal history, if any. Should there be information received on the fingerprint results, which the applicant deems to be inaccurate, there is a process, which the applicant can follow to challenge the information on their Criminal History Record Information, which can be viewed here.

Work Permit/Non-Key Employee License
Individuals who do not meet the criteria to be licensed as Key Employee/Gaming Employee or Primary Management Official will undergo a background check and be licensed as a Work Permit/Non-Key Employee. All Work Permit/Non-Key Employee Applicants will be required to provide:
Ten years of residential history; Five years of employment history; Disclosure of all felony charges, arrests or convictions; Disclosure of all misdemeanor arrests or convictions received within the past ten years; Disclosure of all arrests or criminal charges received within the past ten years, whether or not there is or was a conviction, if not otherwise disclosed;

Vendor License
All business entities that are required to obtain a Gaming Resource Supplier or Vendor License will need to provide:
Scope of Work to be performed/Contract; Articles of Incorporation/Articles of Organization; Financial Statements; Business Licenses;
FALSE STATEMENTS
Deliberate misstatements to investigators or omissions on the gaming application can result in your disqualification, regardless of the nature or reason for those misstatements/omissions. In brief, it is imperative that all applicants provide complete and accurate information to the Gaming Commission during the background process.
CONTINUING DUTY
All licensees are required to report all changes in the background information provided on their application (e.g. address change, financial issues, civil litigation, subject in an arrest, pending criminal charges, or convictions) within ten (10) business days.

LICENSE DURATION
Gaming Licenses are valid for two years. After two years, each licensee will go through a renewal background investigation to ensure adherence to the standards required to maintain a gaming license.
FEES
ALL NEW AND RENEWAL APPLICANTS WIL BE SUBJECT TO TMGA’S LICENSING FEE’S UNLESS OTHERWISE STATED IN WRITING, OR WAIVED BY THE TMGA. LICENSING FEES ARE AS FOLLOWS; NEW APPLICANTS; $1,000.00 (PMO), $500.00 (State Key), $350.00 and $200.00 (Non-Key) and ALL RENEWALS; $100.00. The Casino currently pays these fees for the applicant.
Gaming Dispute Process
1. You must notify the Casino Shift Manager or Department Manager if you feel the dispute is warranted. If the dispute involves and amount at least $500.00 the Red Earth Casino will notify the Torres Martinez Gaming Agency of the dispute.
2. If you are dissatisfied with the Casino Shift Manager or Department Manager’s response you must notify the Assistant General Manager or the General Manager’s office within three (3) business days of the occurrence in an attempt to resolve the gaming dispute.
3. If you do not agree with their response or findings, you must notify the Torres Martinez Gaming Agency in writing with all pertinent facts related to your dispute within fifteen (15) days of the original complaint.
- The Torres Martinez Gaming Agency will investigate your dispute and notify both the Red Earth Casino and you in writing of the final outcome as determined based on the facts and reasons within thirty (30) days of the original notification date.
- Any Patron dissatisfied with the resolution of the Gaming Agency may petition, in writing, requesting that the dispute over any claimed prizes or winnings be settled by to the Torres Martinez Gaming Commission. The written petition must be submitted to the Torres Martinez Gaming Commission within thirty (30) days of receiving the Torres Martinez Tribal Gaming Agency decision.
- The Gaming Commission will decide whether a hearing will be conducted. Written notification to the Patron and Red Earth Casino of the time and place of the hearing, should their presence be deemed necessary. Failure of either party to appear may have an effect on the final decision. After review of the dispute, The Gaming Commission shall have fifteen (15) days to notify, in writing to all concerned Parties, their decision in the matter. The Decision of the Torres Martinez Gaming Commission is final and not subject to judicial review, dispute resolution or other legal action.
- In the dispute letter you must include your full name, date and time of the incident, all relative information, witnesses, current mailing address and phone number so that we may contact you. Please mail your gaming dispute letter to:

The Torres Martinez Gaming Agency handles gaming disputes where a customer feels the Red Earth Casino and/or an employee may have wronged him or her regarding the outcome of a wager made at a gaming device. The Gaming Agency investigates all disputes in a fair and impartial manner as the third party with fairness and integrity as the primary interest. If you decide to initiate a dispute it must be gaming related.
The Torres Martinez Gaming Commission (TMGC) is an independent Tribal governmental agency established by the Torres Martinez Desert Cahuilla Indians (TMDCI), under Tribal law, to regulate gaming activities at Red Earth Casino. As the gaming regulatory authority, the TMGC ensures the Casino maintains a responsible gambling program that provides contact information for free resources offering treatment, support and prevention assistance to affected individuals. Additionally, the TMGC ensures that exclusion programs are available, whereby a patron may be denied access to the Gaming Facility and services, either voluntarily or by the request of a third party.
The TMGC recognizes that problem gambling is a serious issue that can have a devastating impact on the life of the gambler, as well as their family and loved ones. Protecting those who are susceptible to problem gambling is of utmost importance to the tribe, and the TMGC therefore works diligently to ensure that all related exclusion requests are handled compassionately and processed as expeditiously as possible.
